What is the purpose of this notice?

This biometric notice (“Biometric Notice”) explains how Sound Health Systems, Inc. (“SoundHealth,” “we,” “us,” “our’) collects, uses, shares, retains, and destroys your Biometric Data when you use the SONU App and the Spatial Sleep App (the “Apps”). The Apps are Artificial Intelligence (AI)/Machine Learning (ML) enabled acoustic resonance medical devices and App platform that uses patient-specific acoustic vibrational energy to provide personalized relief for nasal congestion and improve sleep quality (the “Services”).

As used in the Biometric Notice, “Biometric Data” includes: (i) “Biometric Identifiers,” which are data generated by measurements of your biological characteristics, such as your retina or iris scan, fingerprint, voiceprint, or a scan of your hand or face geometry; and (ii) “Biometric Information,” which is information based on a Biometric Identifier that can be used to identify you.

Please review this Biometric Notice carefully. By agreeing to our collection of your Biometric Data, you consent to the collection, use, sharing, and retention of your Biometric Data as described in this Biometric Notice.

What type of Biometric Data does SoundHealth collect and how do we collect it?

Facial landmarks. Our Apps utilize a smartphone’s self-facing camera to scan your face and derive dimensions between certain facial landmarks.
Voice. Our Apps utilize a smartphone’s voice recorder to record your voice. We use your voice recordings to identify certain characteristics about your voice, like acoustic vibrational energy.

How does SoundHealth use and share your Biometric Data?

• Facial landmarks. We use the facial landmarks to estimate the boundaries of your sinuses or cranial cavity. This allows us to create a virtual surface from which sinonasal volume is calculated using an AI/ML predictive model. We use the model to determine the resonance frequencies of your nasal or cranial cavities to deliver optimal sound therapy for you. We also use the data internally to improve our AI/ML algorithm. We do not share this data with any third parties except our cloud database provider, which securely stores the data.

• Voice. We use the voice characteristics to identify certain biomarkers (biological indicators). We use an AI/ML predictive model to analyze the biomarkers to predict the improvement in your nasal congestion score from using the SONU App. We also use the data internally to improve our AI/ML algorithm. We do not share this data with any third parties except our cloud database provider, which securely stores the data.

How long does SoundHealth retain your Biometric Data?

We store the derived dimensions related to your facial landmarks, the voice recordings, and biomarkers captured from the voice recording. We retain this data for so long as you maintain an account with us. You can request that we delete your account in accordance with our Privacy Policy. We do not store images of your face.

What happens to your Biometric Data at the end of the retention period?

We permanently delete all derived facial dimensions, voice recordings, and biomarkers when you delete your account with us, unless we are required by law to retain this data.
